In recent years, the changing landscape for the conduct and assessment of research and of researchers has increased scrutiny of the reward systems of science. In this context, correcting the research record, including retractions, has gained attention and space in the publication system. One question is the possible influence of retractions on the careers of scientists. It might be assessed, for example, through citation patterns or productivity rates for authors who have had one or more retractions. This is an emerging (...) issue today, with growing discussions in the research community about impact. We have explored the influence of retractions on grant review criteria. Here, we present results of a qualitative study exploring the views of a group of six representatives of funding agencies from different countries and of a follow-up survey of 224 reviewers in the US. These reviewers have served on panels for the National Science Foundation, the National Institutes of Health, and/or a few other agencies. We collected their perceptions about the influence of self-correction of the literature and of retractions on grant decisions. Our results suggest that correcting the research record, for honest error or misconduct, is perceived as an important mechanism to strengthen the reliability of science, among most respondents. However, retractions and self-correcting the literature at large are not factors influencing grant review, and dealing with retractions in reviewing grants is an open question for funders. (shrink)

O artigo apresenta uma discussão acerca da percepção do imaginário da cultura africana e afro-brasileira e da construção da identidade étnico-racial no enredo escolar. A investigação foi realizada a fim de: 1- analisar os tipos de suportes e referenciais culturais que a escola fornece para a construção da identidade étnico-racial; 2- identificar as consequências do tipo de representação do negro construída e percebida na escola para o desenvolvimento da identidade étnico-racial dos alunos do Ensino Fundamental I. Para tanto, utilizou-se a (...) abordagem de pesquisa qualitativa, empregando o uso da modalidade pesquisa-participante e análise documental do Plano Municipal de Educação de Corrente-PI, município onde a pesquisa foi desenvolvida, Parâmetros Curriculares Nacionais e a Base Nacional Comum Curricular. A participação direta ocorreu por meio da realização de uma oficina de leitura realizada em uma turma do 2º ano do ensino fundamental, contemplando a literatura fornecida pelo PNBE, que versa sobre a construção da identidade étnico-racial. Diante da problemática e da dificuldade de implementação das leis que regem o ensino da temática, a pesquisa torna-se relevante, pois, longe de se esgotar a uma conclusão final, este estudo reforça a necessidade do constante debate e a busca por efetivação de práticas educativas que formem cidadãos emancipados e forneçam subsídios para os negros se autoafirmarem e para a valorização da cultura de matriz africana. Assim como a necessidade da busca por adequação, implementação, monitoramento e avaliação constante das leis que regem o ensino de história e cultura africana e afro-brasileira. (shrink)

in this article, we experience the exercise of a screen ethnocartography in agency with the film Beasts of the southern wild by the director Benh Zeitlin. We tested a film experimentation that led to a renewed writing ways of life. We bet on cinema and childhood as possibilities for creating cracks and a stutter of language for the creation of new worlds and ways of living. In cinema images less as a representation, and more as art that proposes incompleteness, fissure, (...) a hole in appearances. In childhood as an exercise of differentiation and resistance to dominant narratives in a given context. In childhood as a limiting experience of/in language, tirelessly exposing the human condition in front of the world. Thus, accompanying the main character of the plot, little Hushpuppy — a six-year-old resident of the “Charles Doucet Island”, experienced as “the Bathtub” —, we are shaken by the forms of life there, considered bestial and not recognized by city humans. Hushpuppy, his father and friends resist attempts to destroy their existence by the forms of the state that try to domesticate them, imbued with the logic that primitives must come to civilization, just as children must become adults. Com este artigo pretende-se investigar como, para Heidegger, o problema da realidade é colocado sem recurso tradicional à intuição interna, ou seja, não é colocado em moldes metafísicos, mas retomado como problema ontológico a partir da analítica existencial do Dasein. Pleiteia-se, também, apontar o quanto a psicanálise winnicottiana nos lega uma forma não metafísica de entender a experiência humana, na medida em que não a reduz a um campo de relações pulsionais entre objetos internos e externos, em que não entende (...) a representação como única forma de acesso à realidade. A intenção é, então, investigar como o problema da constituição da realidade se impõe como questão necessária, tanto na crítica winnicottiana à metapsicologia quanto na crítica heideggeriana à metafísica.With this article we intend to investigate how for Heidegger the problem of the reality is considered without the traditional resource to the internal intuition, that is, it is not considered in metaphysical aspects, but reassumed as an ontological problem according Dasein's Existential Analysis. Still, we plead as well to point how much Winnicott's psychoanalysis give us a non-metaphysical way to understand the human experience, once it doesn't reduce it to a field pulse relations between internal and external objects, in which the representation is not understood as the only access way to reality. We intend then, investigate how the problem of the constitution of the reality imposed as necessary matter in the Winnicott's criticism to metapsychology and in Heidegger's criticism to metaphysics. Com esse artigo pretendemos examinar duas posições distintas em relação ao conceito metapsicológico de pulsão e à identidade epistemológica da psicanálise. Ao investigar as bases ontológicas da metapsicologia, o filósofo Martin Heidegger encaixa a psicanálise freudiana no rol das ciências da natureza. Para Heidegger, ao usar o conceito de pulsão para descrever as nossas urgências e ímpetos, Freud estaria usando um constructo teórico carregado de uma objetividade não-humana. Ricoeur, por sua vez, advoga que o conceito de pulsão teria o poder (...) de sintetizar os elementos de força e de sentido presentes na teoria freudiana. Apesar de funcionar como uma força que faz o aparelho psíquico trabalhar, essa força pulsional nunca seria “nua”, desprovida de uma representação psíquica que lhe conferiria sentido. Por isso, o conceito de pulsão afinaria a psicanálise com a hermenêutica. Nosso objetivo consiste em analisar os fundamentos que guiam tais posições. (shrink)

Habermas anuncia em sua obra Pensamento Pós-Metafísico o fim da metafísica enquanto pensamento totalizador e auto-referente que pretende um acesso privilegiado à verdade. A desvalorizaçáo deste modo de pensar culmina na passagem para o que ele denomina de pensamento pós-metafísico, fazendo-se necessário um redimensionamento do papel da filosofia, visto que um novo cenário de pensamento se instaura. O presente artigo pretende problematizar, à luz da filosofia de Heidegger, os pressupostos habermasianos que fundamentam a sua constataçáo do fim da metafísica. This article studies the conceptions of the interior of the Earth held by Portuguese elementary school children and senior citizens. Several studies were conducted regarding conceptions related to Earth sciences, such as rocks, minerals, earthquakes geological time, and Earth structure. Most of these studies involved students enrolled in compulsory education, some involved higher education students, several involved teachers, and only a few involved adults. The majority of the results showed that many misconceptions are held by people of all ages. Similar (...) results were found in this study, as both children and senior citizens revealed several misconceptions. The research resorted to a questionnaire based on a drawing task so as to find out the way that children and senior citizens imagine the structure and composition of the interior of our planet. A comparison between children’s and senior citizens’ drawings was made, as well as a comparison between those drawings and the historical models of the internal structure of the Earth. We found that only a small number of children and even a smaller number of senior citizens recognize that the interior of the Earth is organized in concentric layers. They assume that soil and water are a common part of the internal composition of our planet. Similarities between the drawings and the historical models were identified, particularly similarities related to Gautier’s model, which accepts the possibility of the existence of life in the interior of the planet as it happens on its surface. This article aims to make public part of the research on the concept of ‘light’ in the theological and, above all, liturgical tradition of the Greek Orthodox Church, based on its representation of the concept of ‘hypostasis’. Taking as a point of departure the interpretation of the expression ‘light of light’ [φῶς ἐκ φωτός (phôs ek phōtos)] of the text of the Niceno-Constantinopolitan Symbol, the article presents a proposal for the interpretation of the concept of ‘representation’ for this specific case, (...) based on the idea of apomímesis, and applies this concept to a reading of the place of ‘light’ in the Holy Scripture, in the Patrology and in the Greek Eastern Liturgies. A notion of delegated causality is introduced here. This subtle kind of causality is dual to interventional causality. Delegated causality elucidates the causal role of dynamical systems at the “edge of chaos”, explicates evident cases of downward causation, and relates emergent phenomena to Gödel’s incompleteness theorem. Apparently rich implications are noticed in biology and Chinese philosophy. The perspective of delegated causality supports cognitive interpretations of self-organization and evolution.

A promising recent approach for understanding complex phenomena is recognition of anticipatory behavior of living organisms and social organizations. The anticipatory, predictive action permits learning, novelty seeking, rich experiential existence. I argue that the established frameworks of anticipation, adaptation or learning imply overly passive roles of anticipatory agents, and that a fictionalist standpoint reflects the core of anticipatory behavior better than representational or future references. Cognizing beings enact not just their models of the world, but own make-believe existential agendas as (...) well. Anticipators embody plausible scripts of living, and effectively assume neo-Kantian or pragmatist perspectives of cognition and action. It is instructive to see that anticipatory behavior is not without mundane or loathsome deficiencies. Appreciation of ferally fictionalist anticipation suggests an equivalence of semiosis and anticipation. (shrink)

Este texto busca levantar reflexões sobre a importância e necessidades da educação para as relações étnico-raciais e promoção da educação antirracista. A partir do uso conceitual de letramento racial crítico e, da análise de legislações que consideramos oportunas para o enfrentamento do racismo, tais como a Lei nº 14.532, de 11 de janeiro de 2023, Lei nº 7.716, de 5 de janeiro de 1989, que visam criminalizar o racismo, e da Lei nº 10.639, de 9 de janeiro de 2003 sobre (...) a obrigatoriedade do ensino de história e cultura da população afro-brasileira e africana, as compreendemos como avanços no combate ao racismo. Em vista de levantarmos possibilidades para o desenvolvimento de um ensino pautado na luta antirracismo a partir e de que promova o letramento racial crítico, levantamos algumas observações sobre a música Bluesman, de Baco Exu do blues, como alternativa para o levantamento reflexivo em sala de aula para a valorização da história e identidade da população negra. Surgiram assim interpretações, quadros, configurações e reconfigurações, ângulos de análise diversificados que fomentarão, por certo, uma reflexão viva dos leitores. É fundamental — continua a sê-lo — repensar e questionar campos temáticos à luz das análises teóricas e concetuais, (...) mas também dos processos, das dinâmicas, das relações, das potencialidades explicativas da nossa contemporaneidade. É assim que se entende este livro, com muitas contribuições, que vêm propiciar e enriquecer a reflexão sobre Outros Combates pela História. Combates pela História é, como se sabe, o título de um livro famoso de Lucien Febvre dos anos cinquenta. Através de uma recomposição, de novo se deu importância a todas as modalidades da História, mantendo, todavia, o sentido do rigor que era algo perseguido nos «combates pela História». Quer-se, pois, analisar o sentido da História, nas suas várias áreas. Contudo, ao propor-se este tema, não se desejou que os autores apresentassem tanto as suas investigações nas suas áreas próprias — embora elas estivessem subentendidas e devessem ser expressas —, mas que refletissem sobre o seu sentido no âmbito da História entendida como Ciência Social e Humana. Para tal, desejou-se que discutissem o objeto e o método da História das diversas áreas, equacionando os seus vários problemas. Foi isso que também sucedeu — estamos disso convencidos. Mas será o leitor, melhor do que ninguém, a ajuizá-lo. (shrink)

Predatory pricing is one of the forms of the abuse of a dominant position. Judicial institutions of the European Union and Commission during analysis of predatory pricing devote main attention to the relationship between costs and prices of the dominant undertaking. Moreover, attention is paid also to various cost benchmarks: average variable costs, average avoidable costs, average total costs and long run average incremental costs. European judicial institutions should pay less attention to the costs of a dominant undertaking than to (...) evaluation of the effect of the actions of a dominant undertaking to consumers and competition in the market. Moreover, proposition of the Commission to use average avoidable costs in predation cases does not correspond to the practice of the Court of Justice and the General Court. The Commission should stipulate more clearly how average avoidable costs and long-run average incremental costs should be calculated in order to increase legal certainty of the undertakings. Establishment of prices higher than average total costs by the dominant undertaking should not be recognized as predatory pricing. (shrink)

Abuse of a dominant position is one of the key aspects in EC competition law. The Court of Justice and General Court acknowledge that sometimes the actions of dominant undertaking that might be recognized as abusive should not be prohibited on the basis of Article 102 TFEU, if undertaking provides objective justification or proves that its actions generate positive effect which outweighs negative outcome on competition. Therefore, actions that usually are regarded as predatory pricing, which is one of the forms (...) of the abuse of a dominant position, in case of special circumstances might be recognized as legitimate. In the present case, attention should be devoted to objective justifications, since this provides the basis for evaluation of legitimate, pro-competitive reasons that explain why undertakings may establish prices lower than costs. This article is devoted to the analysis of objective justification, which might prove that allegedly abusive behaviour is actually legitimate. Plenty of factors might be recognized as objective justifications, therefore it is quite difficult to provide a finite list of justifications. (shrink)

One of the most important principles of the European Community law is the prohibition of the abuse of a dominant position based on Article 82 of the EC Treaty. Predatory pricing is one of the forms of the abuse of a dominant position. It is likely that the world financial and economic crisis will lead to an increase in competition among the undertakings. The fact that some dominant undertakings seeking to sustain or increase their market share might decide to engage (...) in predatory pricing and that no comprehensive research on predatory pricing has been carried out by legal scholars in Lithuania and the European Union up to date, underlines the relevance of this study. To decide whether dominant undertaking has become a “predator”, it is necessary to evaluate several issues, such as the ability of the dominant undertaking to recoup its losses incurred during the alleged application of predatory pricing strategy. The judicial institutions of the European Union pay little attention to this issue and might recognize that predatory pricing took place even without the evidence on the possibility for the undertaking to recoup its predatory losses. This study analyses the recovery of predatory losses by the dominant undertaking and the importance of such recovery in determining whether or not the dominant undertaking engaged in predatory pricing. The aim of this article is to analyse different goals of the competition law, which are established in European Union and Lithuania. EU Commission and the Court of Justice distinguish a number of goals of the competition law. Most commonly, mentioned goals of competition law are the following: the integration of the Internal Market, the protection of consumers, protection of the competitors, freedom of competition and economic efficiency. Different goals of competition law are analysed in this paper and relationship between (...) them is explained. Special attention is given to the analysis of protection of the consumers as one of the main objectives of competition law. While analysing protection of the consumers in competition law, a difference between the concept of consumer in competition law and consumer protection law is explained. The authors express a number of critical thoughts towards practice of the EU Commission and the Court of Justice so far, as there is a lack of consistency in evaluation of the protection of consumers’ rights in the context of the other objectives of competition law. Relevance of the present article is supported by the several facts such as revision of the competition law goals by the EU Commission and adoption of resolution “Concerning priority of the activities of the Lithuanian Competition Council” by the Lithuanian Competition Council that establishes main principles (priorities) applied while implementing competition policy in Lithuania. Setting out the main goals in Lithuanian competition law may have important practical consequences in the everyday activities of the Lithuanian national competition authority. (shrink)

One of the most important principles of EC law is the prohibition of the abuse of dominant positions as established in Article 102 TFEU. Predatory pricing is one of the forms of abuse of a dominant position. In order to decide whether the dominant undertaking has referred to predatory pricing it is necessary to evaluate several elements, one of which is analysis of the intent of the undertaking. European judicial institutions and Commission while assessing predatory pricing give too much importance (...) to the intent of the dominant undertaking. It should be recognized that intention to use predatory pricing is only additional evidence for the determination to undertake an abused dominant position. Intent to eliminate competitors and to take a big part in the market is the aim of all dominant undertakings, the driving force of competition. Competition law officers should inquire whether pricing will cause elimination of competitors and damage to consumers. If competition law officers will provide too much importance to consideration of intent in that case competition law rules will be applied to strict and dominant undertakings and will not charge low prices that are good for consumers. The author- following his own research on the subject- argues that Wittgenstein ignores argumentation theory and in general, the problems of rhetoric and argumentation. From this point of view, he frames Stephen Toulmin’s reading of Wittgenstein, arguing that the British philosopher- who was a student of the Austrian- advocates precisely the same thesis. He explains that this happens in a very peculiar (rhetorical) context on Toulmin’s part; a context in which, in essence, Wittgenstein’s philosophy is being rehabilitated.

We discuss prior publication and redundancy in contemporary science in the context of changing perceptions of originality in the communication of research results. These perceptions have been changing in the publication realm, particularly in the last 15 years. Presenting a brief overview of the literature, we address some of the conflicts that are likely to arise between authors and editors. We illustrate our approach with conference presentations that are later published as journal articles and focus on a recent retraction of (...) an article that had been previously published as a conference proceedings. Although we do not make definitive pronouncements on the matter—as many concepts are evolving—we do argue that conference papers that contain sufficient details for others to attempt a replication and are indexed in scientific databases such as PubMed, challenge some currently held assumptions of prior publication and originality in the sciences. Our view is that these important issues are in need of further clarification and harmonization within the science publishing community. This need is more evident when we consider current notions of research integrity when it comes to communication to peers. Revisiting long-standing views about what constitutes prior publication and developing a clearer set of guidelines for authors and editors to follow should reduce conflicts in the research environment, which already exerts considerable pressure, especially on newcomers in academia. However, while clearer guidelines are timely, developing them is only part of the challenge. The present times seem to call for deeper changes in the research and publication systems. (shrink)
